These Terms and Conditions (also herein and elsewhere referred to as "User Agreement", "Agreement", or "Terms of Use") set forth how Inside Insights, Inc. and InsideInsights.info (also herein and elsewhere referred to as "Company", "we", "us", or "our"), including our legal successors and assignees, and you, the user (also herein and/or elsewhere referred to as "you", "You", "your", "Your", "user", "User", "visitor", "Visitor", "participant", "Participant", "attendee", "Attendee", "student", "Student", "subscriber", "Subscriber", "customer", "Customer", "client", "Client", "member", "Member", "reader", "Reader", "affiliate", or "Affiliate"), agree to respect each other and each other’s property while and after you are using our websites, pages, or other information, including but not limited to programs, courses, classes webinars, materials, recordings, events, products, blog posts, or other services (collectively, Services).

These Terms and Conditions constitute a legally binding agreement between you, personally and, if applicable, on behalf of the entity for whom you are using our Services (collectively, “you”), governing your use of any/all of our Services. By accessing our Services, you are agreeing to comply with and be bound by these Terms and Conditions. You also agree to our privacy policy, which you should review carefully. By accessing this website, we assume you accept these terms and Conditions. Do not continue to access or use any of our Services if you do not agree to all of the terms and conditions stated on this page and in our Privacy Policy.

  • Refunds and Returns: Except as otherwise agreed by the parties in writing, the Company’s refund and/or return policy for the products and/or services it provides to you is set forth in these Terms and Conditions. The Company may provide a different refund/return policy in its marketing materials for each service and/or product that it sells and/or provides to you, including that no refund or return may be available for certain services or products. These policies may change at any time at the Company’s sole discretion. Company shall not be liable for any untimely or improper refund or return requests, or for any loss of profits or costs, or for any direct, indirect, special, incidental or consequential damages, including costs associated with the procurement of substitute goods or services (whether or not Company was or should have been aware or advised of the possibility of such damage), arising out of or associated with any loss, suspension of service, interruption of service, termination of these terms and conditions, use or misuse of our materials or content, or other performance of services hereunder. Any breach by you of this Agreement shall immediately and completely disqualify you as to any refund that may have been available to you immediately prior to such breach. Any refund made will be credited back to the same payment method used to make the original purchase, less a 5% transaction processing fee. You agree and acknowledge that all of these terms and conditions are fair, equitable and reasonable to both parties, including but not limited to the provisions of this section and the Terms of Use as a whole. WE OFFER NO REFUNDS ON ANY SERVICES OR PRODUCTS DESIGNATED ON THIS SITE AS NONREFUNDABLE OR NONRETURNABLE.

    • Fees for courses, classes, webinars, recordings, events, subscriptions, or memberships are nonrefundable once access has been made available to the user, or once materials have been purchased by the Company to be provided to the user, or once the start date for a course, class, webinar, or event has commenced or passed.

    • Assessments or credits that can be used to assign or complete assessments are nonrefundable once the Company has purchased credits on behalf of a customer or assigned one or more assessments to any individual(s) as requested by a customer. 

    • Training, coaching, consulting, database development, or other services provided are nonrefundable. Travel costs incurred for on-site Services such are not refundable, even if customer or client cancels Services. Deposits made to reserve on-site Services are nonrefundable.

    • For other services or products, you agree to make any requests for any available refunds or returns before or on any applicable deadline by email at the following address: training@insideinsights.info including the word “refund” or “return”, as applicable, in the subject line of your email.

    • Prior to issuing or processing any form of refund and/or return that may be available, the Company may, at its sole discretion, require you to certify in writing that you already have fully completed and fulfilled your obligation hereunder to thoroughly search for, and to permanently delete and destroy, all digital or electronic Company-provided documents or materials, and to return and/or destroy (at the Company’s sole discretion) all physical Company documents or materials that are in your possession, including without limitation any or all copies or printouts you may have made of any Company documents or materials. Also, prior to issuing any form of refund and/or return that may be available, at Company’s sole discretion, it may require that you recertify and pledge to continue to uphold your obligations under these Terms and Conditions and under any other agreement you have made with the Company, the terms and provisions of all of which shall continue to apply to the parties hereof and continue as valid and binding agreements, including after any such refund or return is completed, for the longest period available under applicable law.

  • ​Other Terms & Conditions: All of the provisions of this Agreement, our Privacy Policy, and any other applicable Company policies and/or agreements are incorporated by reference into these Terms and Conditions. We make no guarantees or warranties about any information on our site, including without limitation any warranty of fitness for a particular purpose. Anyone visiting or subscribing to our website or using any of our programs, courses, classes, webinars, events, recordings, subscriptions, memberships, products, posts, pages, or other services is also agreeing to these terms and conditions. Any user providing us their email address in exchange for our delivering any content to them or who is registering themselves or someone else for one or more of our programs, courses, classes, webinars, events, webinars, recordings, subscriptions, or memberships is also consenting and agreeing to receive emails from us on a regular basis. Any of our subscribers may unsubscribe at any time by clicking the link or button provided in the footer of any of our emails. This Agreement and any other legal document or agreement we have entered into with you will supersede any previous terms and conditions you may have copies of in any form, regardless of whether we or you have signed them or not. We reserve the right to make changes to this site and these Terms and Conditions at any time.

  • Indemnification. User agrees to defend, indemnify and hold harmless Company, its officers, affiliates, directors, agents, and employees from and against any and all property damage, personal injuries or death, and other liability, loss, cost, expense, or damage, including, without limitation, court costs and reasonable attorney’s fees arising out of User’s personal individual conduct, actions or inactions, and/or from User’s breach of any of the terms of this Agreement or the Company’s Privacy Policy.

  • Entire Agreement: This Agreement constitutes the entire understanding between User and Company with respect to any and all use of the website or Company’s programs, courses, classes, webinars, events, products, recordings, posts, content, subscriptions, memberships, or other services or products. This Agreement supersedes and replaces all prior or contemporaneous agreements or understandings, written or oral, regarding the relationship between User and Company.

  • Severability and Interpretation: Whenever possible each provision of these terms and conditions shall be interpreted in such a manner as to be effective and valid under applicable law, but if any provision of these terms and conditions shall be prohibited, void, invalid, or unenforceable under applicable law, such provision shall be ineffective to the extent of such prohibition, invalidity, voidability, or enforceability without invalidating the remainder of such provision or the remaining provisions of this agreement. The Company and you agree that any ambiguity, vagueness or applicability of any provision of this agreement shall not be construed against the drafting party because of its being the drafter of this agreement.

  • Survival: All obligations of the parties hereto contained in this agreement shall survive the expiration or termination of this agreement.

  • Dispute Resolution: In case of a dispute between User and Company relating to or arising out of this Agreement, the parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, the User and the Company shall then submit the dispute to binding arbitration. The arbitration shall be conducted in the county and state noted in the Governing Law section of this Agreement. The arbitration shall be conducted by a single arbitrator, and such arbitrator shall have no authority to add any party, vary the provisions of this Agreement, award punitive damages, or certify a class. The arbitrator shall be bound by applicable and governing federal law and state law of Tennessee. User and Company hereby agree to each pay their own costs and fees. Claims necessitating arbitration under this section include, but are not limited to: contract claims, tort claims, claims based on federal and/or state law, and claims based on local laws, ordinances, statutes or regulations. Intellectual Property claims by Company will not be subject to arbitration and may, as an exception to this subpart, be litigated. User and Company, in agreement with this subpart of this Agreement, waive any rights they may have to a jury trial in regard to arbitral claims.

  • Governing Law: This agreement shall be construed under the laws of the State of Tennessee without regard to conflicts of law principles.

​​

  • Counterparts: This agreement, and any other agreements we may enter into with you later, may be executed in several counterparts or by separate actions between or among its parties, each of which shall constitute an original and all of which, when taken together, shall constitute one agreement. You understand and agree that your accessing and/or using the information on this website constitutes your complete assent and, as applicable, the assent of the company, group or organization you represent, to all of these Terms and Conditions, which shall be considered valid, binding, and effective for all purposes.

  • Headings and Interpretation: The headings for sections herein are for convenience only and shall not affect the meaning of the provisions of this agreement. The parties agree that no provision of this agreement shall be interpreted against the drafting party because of its being the drafter of it.

  • Notices. All notices, requests, consents, claims, demands, waivers, and other communications hereunder (each a “Notice”) shall be in writing and addressed to the User and Company. All Notices from Company to User relating to this Agreement will be sent to the email address User provided to Company. Any Notices from User to Company relating to this Agreement must be sent to training@insideinsights.info. A Notice is only effective if (i) the receiving party has received the Notice and (ii) the party giving the Notice has complied with the requirements of this section.
